HIGH COURT SETS DATE TO HEAR ORAL SUBMISSIONS ON POW AND CPRE PLANNING CHALLENGES
The High Court has agreed to hold a hearing, expected to be in early July, to determine if POW and CPRE’s challenge to Waverley’s Local Plan and POW’s challenge to the Secretary of State for Housing, Communities and Local Government’s decision to approve 1,800 houses on Dunsfold Aerodrome should proceed. The High Court has also agreed with POW’s request that all three challenges should be consolidated and heard together. If the High Court gives permission to proceed then full hearings will be heard at a later date.
POW Chairman Bob Lees said “POW is pleased that we have the opportunity to present our case for leave to proceed. All three cases raise significant legal issues, both in the adoption of the Local Plan and the granting of planning consent. It is right and proper that the people of Waverley should be able to hold the Council and the Secretary of State to account if they have legitimate grounds to do so.”

- The application by Dunsfold Airport Limited and Rutland Limited to build 1,800 houses on Dunsfold Aerodrome was approved by Waverley Borough Council in December 2016. How- ever, in March 2017 following local pressure, the application was called in by the Secretary of State for him to determine because of his concerns about the location and its sustainability (under sec on 77 of the Town and Country Planning Act 1990). As a result, and briefing a major and controversial development affecting thousands of people, a full Public Inquiry was held by Government Planning Inspector Philip Major from 18th July to 3rd August 2017.
- Waverley Borough Council adopted its Local Plan Part 1 on 20th February 2018. POW and the Council for the Protec on of Rural England (CPRE) have both lodged legal challenges against it on the basis of the need for housing. The Plan provides for 2,600 houses to be built on Dunsfold Aerodrome.
